Her Majesty The Queen T-463-07 – Denis Manuge brought a class action against the Government of Canada on behalf of approximately 7,500 disabled Canadian Forces veterans whose LTD income replacement benefits were reduced by the amount of their Pension Act disability pensions for pain and suffering. On May I, 2012, the Federal Court ruled that the wording of LTD insurance policy did not permit the reduction, the two benefits were for completely different purposes, and that the practical effect on the most severely disabled veterans was particularly harsh. The parties have subsequently negotiated a proposed settlement, which dates back to 1976 and is valued at approximately $887 million. The proposed settlement has been submitted to the Federal Court for approval.
